to the virginia coast. news 4 midday begins right now. >>> good morning and welcome to news 4 midday. it's wednesday, the 1st of september, 2010. hurricane earl is barreling toward the east coast. bob mcdonnell has declared an emergency today. right now the storm has set its aim on north carolina. some tourists along the outer banks have been evacuated. more evacuation orders are possible as earl approaches. earl has been downgraded it a category 3 storm, but it's still a potentially powerful hurricane. we begin our coverage with tom kierein who has been tracking the storm for days. >> it did weaken a little bit overnight and that's good news and also the track changed overnight. the forecast track from the tropical depreks center coming up here, right now as we take a look at this view over the last 12 hours, this is a live view from the beach. there are clouds developing ands surf is not too bad. beautiful first day of september there for now, but this same scene by thursday afternoon and evening and into friday is going to be all different because there is earl. you can see sort of a

right. breaking news overnight because this is happening in virginia. a woman has been executed for the first time in almost 100 years. theresa lewis was convicted in 2003 of plotting the murder of her husband and stepson. she apparently wanted their insurance money. she died by lethal injection. lewis' final words were for her stepdaughter. >> miss lewis did make a last statement. she said i just want kathy to know i love her. and i'm very sorry. >> protesters were outside the prison arguing that lewis was treated unfairly, apparently he was very close to the i.q. line where you're not supposed to get executed. police trying to figure out who killed a nicaraguan diplomat in his apartment in the bronx here in new york. he was found on the floor. his throat had been slashed. this just hours before he was scheduled to attend the u.n. general assembly. witnesses say there was a fight in the apartment the night before the murder. police believe he probably knew his killer. >> people filling sandbags now all across southern minnesota and western wisconsin. that's going to happen a
with the latest. >> reporter: later today, president obama heads to northern virginia to mark the six-month anniversary of the health care reform law, hailing some of the new protections that take effect this week. 4-year-old myra rakers' life will change this thursday in ways she's probably too young to understand. >> in the next couple of days, the most sweeping set of consumer protections go into law. >> reporter: protections like a ban on insurance companies imposing a lifetime limit on essential health benefits. just four years into her life, myra has had a kidney transplant and already hit her $500,000 lifetime coverage cap. >> they won't pay the claims. >> reporter: come september 23rd the insurance companies won't have a choice. >> just a huge weight has been lifted off of our shoulders. >> reporter: insurers will no longer be allowed to deny coverage to children even if they have pre-existing conditions, or stop providing coverage to customers because of technical errors on past applications. of course, these consumer protections don't come without a cost. >> impact is likely
